Objective

Applicability
- Applies to all organizations, workplaces, and establishments in India.
Sexual harassment includes:
- Unwelcome physical contact.
- Sexual advances or gestures.
- Verbal abuse or inappropriate remarks.
- Display of pornographic materials.
- Any unwelcome conduct that creates a hostile or intimidating work environment.
- Right to file a complaint against sexual harassment.
- Right to receive support from the organization during the process.
- Right to be heard and work in a safe and supportive environment.
- Create and Implement a POSH Policy: Make employees aware of the guidelines.
- Form an Internal Complaints Committee (ICC): Ensure compliance with the Act.
- Conduct Training and Awareness Programs: Educate employees about sexual harassment and prevention.
- Ensure Confidentiality and Fairness: Handle complaints with sensitivity and impartiality.
- Take Necessary Action: Discipline offenders as per the findings.
- Filing: Submit a written complaint to the ICC.
- Inquiry Process: The ICC investigates complaints, ensuring privacy.
- Resolution Timeline: Address and resolve issues within 90 days.
- For Offenders: Disciplinary actions may include suspension, dismissal, or legal action.
- For Non-Compliant Organizations: Legal penalties and fines for failing to comply with the POSH Act.
